Child Support is Required by Law
Florida Statutes set forth guidelines for the calculation of child support payments based upon the combined net income of the individual parties and the number of children born of the marriage. There are only certain, limited instances in which a deviation from the guidelines are allowed. Pam Mills, your child support attorney, can help you gather the required information and determine the appropriate amount of support legally required to support your children, calculate the financial obligation of both you and your spouse, and determine the amount of child support that you should either be paying or receiving.
Changes in Child Support
Changes in the amount of child support due require modifications to existing court orders. A change may be necessary due to a significant change in income of one or both parties, the age of the children, or other unusual circumstances. Your child support lawyer can help you decide if and when it is appropriate to petition the court for a change in child support and follow through with that action when appropriate. Call Pam Mills and get your children the support that they deserve!
Enforcement and Contempt Actions
Enforcement with regard to child support is an action taken by the court when one spouse has willfully failed to follow a child support order of the court. In certain enforcement actions, one spouse may seek contempt of court involving fines and/or incarceration for the disobedient and breaching spouse. However, the goal is generally to recover delinquent child support payments and provide your children with the support that they deserve. It is important to note that the court normally makes no connection between child support delinquency and visitation rights. The court will not suspend visitation due to failure to pay child support. If you are not receiving court-ordered child support in the manner prescribed in your child support order, and would like to pursue compensation, contact Pam Mills for help!
Paternity Actions
Paternity actions involve the legal determination of the biological parent, usually the father between unwed individuals, and for the subsequent determination of child custody, support, visitation and parenting between the parties. If you would like to initiate paternity proceedings either in an effort to receive support for your child, or to exert your parental rights regarding visitation and decision-making, call Pam Mills today!
