Equitable Distribution
Equitable distribution involves the equitable, but not necessarily equal, distribution of all assets and debt accumulated during the marriage. The parties marital assets must be completely disclosed to each other in the form of a financial affidavit and in the disclosure of certain, required, mandatory documentation between the parties. In certain instances, assets owned before the marriage but which increased in value during the marriage, can be considered a marital asset subject to equitable distribution. Likewise, the parties marital debts are also subject to equitable distribution. You need a good divorce lawyer to ensure that you are not taken advantage of in this situation. Call Pam Mills today!
Alimony
Depending upon the length of the marriage, Florida Statutes recognize a spouse’s right to alimony if there is a need for support by one spouse and the other spouse has the ability to pay. There are several classifications of alimony, such as permanent periodic, rehabilitative, bridge-the-gap and lump sum alimony. Alimony may cease when the receiving spouse either remarries, cohabits in a supportive relationship, and/or no longer has a need for alimony. Your divorce attorney can help you determine if alimony is appropriate in your case and ensure that it is set at a fair and equitable amount. Also, alimony may cease when the payer spouse seeks a modification based upon a substantial change of income or circumstances.
Marital Home
If there is no agreement between the parties seeking dissolution of marriage regarding which spouse retains exclusive possession of the marital home and which spouse will voluntarily leave the home, then a hearing before the court regarding exclusive possession will be required. Very often, one spouse will buy out the other spouse’s equitable interest in the marital home in order to retain ownership of the home or the home is sold on the market and the proceeds equitably distributed between the parties. Your divorce lawyer can assist you by legally documenting any agreement between you and your spouse to avoid any misunderstandings regarding the marital home and the distribution of the equity and debt related to the home.
