Domestic Violence
Domestic abuse is never okay. Unfortunately, domestic violence happens and is on the increase. Fortunately, there are resources for abused spouses or those involved in an abusive relationship to assist them in withdrawing from the abuser and to help them adjust as they begin a new life. A domestic violence injunction is a court order enforceable by law enforcement that notifies the abuser that he is not allowed to contact or be within 500 feet of the abused spouse for a certain period of time, most often one year. In addition, domestic violence injunctions usually lead to the arrest of the abuser under charges of domestic battery or aggravated assault. There are also shelters, counseling services and other resources available in the community to assist those suffering from domestic violence. Modifications
Modifications are actions filed to modify prior judgments and orders of the court. This may include an increase or decrease of child support or alimony based upon a significant change of circumstances.
Enforcements and Contempt Actions
Enforcement actions involve the enforcement of certain details or issues in prior judgments and orders of the court where one spouse has willfully failed to follow a marital settlement agreement or an order or judgment of the court. In certain enforcement actions, one spouse may seek contempt of court involving fines and/or incarceration for the disobedient and breaching spouse.
Pre and Post Nuptial Agreements
Prenuptial agreements are contractual agreements between prospective spouses setting forth non-marital assets and debt and outlining the rights of the parties regarding the issues involved in divorce before a divorce action is contemplated. While the topic of prenuptial agreements can be a stressful one, it should be understood that a prenuptial agreement can both protect each spouses assets in the event of a divorce, as well as protect each spouse against incurring responsibility for their spouses debts. A postnuptial agreement is an agreement similar to a prenuptial agreement that is executed after a couple is wed.
